Understanding the Permits for Tiki Huts: Chickee vs Tiki Hut

Navigating the world of permits for tiki huts can seem daunting, but Lucas General Contractors LLC is here to guide you through every step of the process. With a wealth of experience in the industry, we understand the nuances and complexities involved in securing the necessary permits for tiki hut construction in Florida. Our expertise ensures your project adheres to all relevant state and local building regulations, bringing you peace of mind as your dream tiki hut takes shape.

A key aspect of this process involves understanding the difference between a Chickee and a Tiki Hut, as the permit requirements differ for each.

A Chickee, or “Chickee Hut,” is a traditional structure of the Seminole Indian tribe, featuring a thatched roof of palmetto or cypress bark and a raised floor. Chickees hold significant cultural and historical value. In the context of permitting, Chickees are generally exempt from Florida Building Codes as per 101.4.1 Exempted Buildings and Structures (61G20-1.001 (24) F.A.C). However, it’s important to note that a zoning permit and approval are still necessary to construct a Chickee hut. Additionally, the addition of modern elements like electrical wiring or plumbing systems would void its status as a Chickee, bringing it under the regular permitting process.

On the other hand, a Tiki Hut, while aesthetically similar to a Chickee, is a more modern, non-indigenous version of the structure. Tiki huts often come with additional features such as built-in bars, entertainment systems, or plumbing. These structures are subject to the regular permitting processes and must comply with all applicable local and state building codes. This can include regulations concerning size, location, and safety standards.

Here is what you Should know about Chickee Huts:

Florida law, under Florida Statutes 553.73 (10)(i), recognizes the cultural and historical significance of “chickee” huts, which are traditionally constructed by the Miccosukee Tribe of Indians of Florida or the Seminole Tribe of Florida. As such, chickees are granted certain exemptions from the Florida Building Code, with the following stipulations:

Chickees are defined as open-sided wooden huts with an attached roof of palm, palmetto, or other traditional materials.

Chickees cannot incorporate any non-wood features. This includes electrical and plumbing components, as well as structural elements such as pavement, bricks, concrete, gravel, pavers, stepping stones, and even wood decks that contain non-wood components (e.g., composite, metal or plastic screws/nails).

Although chickee huts are exempt from the Florida Building Code, they must comply with local zoning codes. If a chickee hut is found to violate these requirements, a notice of violation can be issued, and penalties may be incurred.

Exceptions to these rules that include non-traditional additions or modifications to a chickee hut will require building permits. These additions must also demonstrate compliance with the High Velocity Hurricane Zone regulations.

For prospective tiki hut or chickee owners, it’s vital to understand these regulations and secure necessary permits. Failure to do so may result in fines, mandatory modifications, or even the removal of the structure.

The Importance of Proper Permitting: A Cautionary Tale

When embarking on a tiki hut construction project, it is essential to fully understand the requirements around obtaining the correct permits. Misunderstandings or misinformation in this area can lead to significant legal issues, financial penalties, or in some cases, even the forced removal of the constructed tiki hut.

For example, there have been unfortunate cases where property owners were misled to believe that no permits were necessary for the construction of their tiki huts or chickees. They were left facing fines and legal challenges when it was found that they had not adhered to zoning regulations and building codes.

One such incident occurred in Sarasota County where a couple built a chickee hut in their backyard without obtaining a zoning permit. Under the assumption that chickee huts were exempt from all permits, they went ahead with the construction. However, they were later informed by county officials that even chickees required zoning permits. As a result, they faced penalties and were forced to seek retrospective approval, causing unnecessary stress and financial strain.

In another case in Palm Beach County, a homeowner had installed plumbing and electrical wiring in their chickee, which voided its exemption status. The hut was then deemed a regular structure subject to all building codes, for which no permits had been obtained. The owner faced a substantial fine and was required to either remove the additions or undergo a regular permitting process.

These incidents highlight the importance of proper understanding and adherence to permitting rules. While Chickees are indeed generally exempt from Florida Building Codes, they are not exempt from zoning permits, and adding modern utilities to them changes their status. Conversely, Tiki Huts are subject to all standard permitting processes and must comply with all relevant building codes.

At Lucas General Contractors LLC, we believe that the construction of your dream tiki hut should be a stress-free and exciting journey. That’s why we handle all aspects of the permitting process, from paperwork to communication with building officials, ensuring your project is in compliance with all regulations. By entrusting us with your tiki hut project, you can avoid the potential pitfalls and penalties associated with non-compliance.
